Acceptance of Terms
By registering for and using Chati ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these Terms, you may not use our Service.
Description of Service
Chati provides a WhatsApp-based marketing and customer engagement platform, including but not limited to automated responses, campaign management, and CRM features.
User Registration
3.1. You must register for an account to use Chati. 3.2. You agree to provide accurate, current, and complete information during registration. 3.3. You are responsible for maintaining the confidentiality of your account and password. 3.4. You agree to accept responsibility for all activities that occur under your account.
User Conduct
You agree not to: 4.1. Use the Service for any unlawful purpose or in violation of any applicable laws. 4.2. Send spam, unsolicited, or unauthorized advertising or promotional materials. 4.3. Impersonate any person or entity or misrepresent your affiliation with a person or entity. 4.4. Interfere with or disrupt the Service or servers or networks connected to the Service. 4.5. Attempt to gain unauthorized access to any portion of the Service or any other systems or networks connected to the Service.
Intellectual Property Rights
5.1. The Service and its original content, features, and functionality are owned by Chati and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. 5.2. You retain all rights to any content you submit, post, or display on or through the Service.
Privacy Policy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
Payment Terms
7.1. Some features of the Service may require payment of fees. You agree to pay all fees associated with your chosen plan. 7.2. All fees are non-refundable unless otherwise stated at the time of purchase. 7.3. Chati reserves the right to change its fees upon reasonable notice.
Termination
8.1. You may terminate your account at any time by contacting us. 8.2. We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach the Terms.
Limitation of Liability
To the maximum extent permitted by law, Chati shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.
Disclaimer of Warranties
The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied.
Indemnification
You agree to indemnify and hold Chati harmless from any claims, losses, liability, or expenses (including attorneys' fees) that arise from your use of the Service.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.
Dispute Resolution
Any disputes arising out of or relating to these Terms or the Service will be resolved through binding arbitration in Nairobi, Kenya.
Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

These Terms constitute the entire agreement between you and Chati regarding the Service and supersede all prior agreements and understandings.
